§ 10-21. Rates and charges.

  • The city may regulate rates for the provision of cable services and service charges to the extent permitted by law. If subject to rate regulations, the grantee and city shall comply with the following:

    (1)

    No rates or charges for cable service that are subject to rate regulation shall be effective until grantee files the rates and charges with the city clerk.

    (2)

    The city shall comply with the rules of the Federal Communications Commission regarding the regulation of rates and the procedures regarding confidential business information.

    (3)

    After the grantee submits its existing rates for the or proposed increase in these rates, the clerk shall publish a public notice of these rates and costs giving interested parties, including the grantee an opportunity to file written comments which shall be available in the office of the clerk for public inspection and copying during normal business hours.

    (4)

    Any grantee that willfully or repeatedly fails to comply with a rate decision or refund order directed at the grantee shall be subject to a monetary forfeiture of up to two hundred and fifty dollars ($250.00) per day up to ten thousand dollars ($10,000.00) for any single act as determined by the city council.
