Article I. CABLE FRANCHISE REGULATORY ORDINANCE |
§ 10-39. Unauthorized connections.
(a)
No person shall tap, tamper with or cause to be tapped, tampered with or connected any wire or device, whether physically, electrically, acoustically, inductively or otherwise, to any wire, cable, conduit, apparatus or equipment of a grantee without authorizations from the grantee owning or controlling said wire, cable conduits, apparatus or equipment.
(b)
It shall be unlawful for any person to make any physical connection to any franchised cable system operating in the city that is not authorized by the cable system.
(c)
It shall be unlawful for any person to willfully damage, destroy, remove, obstruct or interfere with any part of any cable system operating in the city.
(d)
It shall be unlawful for any person to make any modification to system equipment or to any system-connected equipment so as to cause any uncompensated franchised cable system to deliver any level of service for which the operator has not received compensation.
(e)
The prohibitions, penalties and remedies set forth in this article for violations of this section are in addition to the penalties and remedies for theft of cable service provided under Federal and state law.
(f)
The provisions of section 10-26 (a)—(d) shall not apply to any complaints concerning any matter covered in this section.
