§ 10-42. Penalty.

(a)

Unless another penalty is expressly provided by this article or the agreement for any particular provision or section, violations of this article may be subject to a penalty of one hundred dollars ($100.00) for each day the violation continues, or may be punishable as a civil infraction by a fine of not more than one hundred dollars ($100.00) for each day the violation continues. Each act of violation and every day upon which any such violation shall occur shall constitute a separate offense except that all similar violations occurring on the same day shall constitute one violation, provided, however, grantee shall not be subject to duplicate monetary penalty for the same violation.

(b)

In addition to the penalties provided in this article or the agreement, the city may enjoin or abate any violation of the franchise or pursue any additional or other legal or equitable remedies available under the franchise or by law.
